FSM Supreme Court Dismisses Challenge to Chuuk Election Results

WENO, CHUUK – A long-standing legal battle surrounding the 2025 Chuuk gubernatorial election reached a definitive turning point. In a decision filed on June 17, 2026, the Federated States of Micronesia (FSM) Supreme Court officially dismissed the appeal brought by gubernatorial candidates Mark Mailo and Joe Enlet.

The Ruling

Presiding Associate Justice Chang B. William ruled that the Court lacks the legal authority—or “jurisdiction”—to hear the case because the appellants failed to meet mandatory statutory deadlines.

The court clarified several key points in its decision:

  • Strict Adherence to Deadlines: Election law requires that any complaint contesting results must be filed within five days of the “declaration of the result”. The Court reaffirmed that these deadlines are “jurisdictional,” meaning if a party misses the window, the court is legally powerless to intervene.

  • Actual Notice vs. Public Announcement: While the appellants argued that the five-day period should only start after a public radio announcement, the Court found this unpersuasive. Because Mailo and Enlet had already received the certified election results on March 14, 2025, they had “actual notice” of the outcome, which triggered the five-day filing requirement.

  • Case Closed: The appeal, which challenged the dismissal of their contest by lower courts, has been dismissed with prejudice. This effectively shuts the door on this specific legal challenge, as the court found no valid basis to intervene in the election outcome.

Background

The case stemmed from a turbulent 2025 election cycle in Chuuk, complicated by a dispute over the legitimacy of the Chuuk State Election Commission, which the Court noted could be referred to as the “rejected” Commission. Candidates Mark Mailo and Joe Enlet had challenged the certified results, but the FSM Supreme Court ultimately determined that their late filing precluded any further judicial review.

The decision serves as a firm reminder that in the Federated States of Micronesia, electoral disputes must adhere strictly to established legal procedures to be considered by the court system.
